The new Federal Fair Work Act has restored unfair dismissal rights for many workers. The Act has also provided workers with a right to claim damages for a breach of a workplace right.
How is unfair dismissal determined?
A dismissal may be unfair not only because it was unjustified, but for any number of reasons. It is important to seek legal advice as soon as possible after dismissal because, in most cases, claims must be filed within 14 days with Fair Work Australia.
